Sellers of properties have sometimes been found to indulge in, knowingly or unknowingly, certain offences that cause a lot of problems to the buyer in the future. This can also lead to financial loss for the buyer, and sometimes can be so grave that the buyer shall not be able to enjoy his property at all. real estate laws have always been designed in such a way that the buyer is protected and hence the seller can be punished, if found to be an offender. Some common and most often repeated offences of sellers are:
- Selling property that does not belong to them: Some individuals try to take advantage of the naivety of the buyer in trapping him into deals that are illegal. These individuals forge documents and signatures, and get into an agreement with a cunning real estate agent to trick buyers into buying properties which have other owners. These people talk sweet and even convince the buyer that they are the actual owners and sell them these properties.
- Selling joint property by hiding the actual ownership: Some Sellers hide the fact that the property is jointly owned and end up selling not only their share but also the entire property to unsuspecting buyers. They hide the fact that the property is jointly owned, so that they can make the entire profit, without having to share, or else to hide the fact the joint owner is not in favor of the sale. By this action, they are not only cheating the buyer, but also the joint owner as well.
- Selling damaged Property: Some sellers indulge in a malpractice of a different way.They hide the defects that are present in the property thereby selling the property by not having to compromise on the price. This leads to the buyer buying a defective property and spending an amount that is not worth it. He is also in danger of the house falling apart because of the defects that have been hidden from him during the sale.
Some offences that may look small but have larger affect on the buyer and the law take these quite seriously as well. Some sellers sign the sale agreement but choose to ignore the agreement when they suddenly get a new buyer who is ready to pay a higher amount. This is an offence of some degree. Hiding certain costs associated with the house, like non-payment of dues to association or non-payment of taxes are also offences. A few smaller issues like using deception to ensure a sale or threatening the buyer to pay a certain amount to close the sale are also considered to be offences and are punishable under law.
